Terms of Business

These Terms of Business are the standard terms which apply to Mobile Pet Care Services. Please read them carefully and ensure that you understand and agree to them. If you have any questions, please contact me.

Any reference to ‘me’ or ‘I’ means Mobile Pet Care Services.

Any reference to ‘Form’ means the ‘Service Agreement Form’, which is used to confirm the booking once an enquiry has been made on: https://www.mobilepetcareservices.com
 
Any reference to ‘Service’ means a pet service at: https://www.mobilepetcareservices.com/services-1
 
1. Contract & Form
 
1a. These ‘Terms of Business’ and the ‘Form’ forms our Contract and Agreement with you.

1b. When you have returned the signed ‘Form’ a legally binding Contract between you and me is created for me to provide a Service detailed on the ‘Form’ and for you to pay for the Service.

1c. Each time you wish to book a new Service and complete a new ‘Form’, then email me a copy of the ‘Form’.

1d. No Service will be confirmed until I have conducted a visit to your property and met with your pet.

2. Price
 
2a. The price of the Service will be the price detailed on the website at the time of booking the Service.
 
2b. All prices are in Pound Sterling (£).
 
2c. I take all reasonable care to ensure that the price of the Service stated on the website are correct and up to date.
 
2d. I will notify you in writing with notice of 14 days of any price increase. You may cancel the service within 7 days of this notice if you are unhappy with the price increase.
 
3. Payment
 
3a. I will invoice you for the Service provided.
 
3b. You must pay each invoice within 7 days of receiving it.
 
3c. The following methods of payment are accepted:
3c1. BACS
3c2. Personal cheques.
 
3d. If payment is made by cheque, the cheque must clear within 7 days of the invoice date.
 
3e. If you do not pay an invoice by the due date we may:
3e1. Charge you interest on the overdue sum at the rate of 8% above the base rate of the Bank of             England until payment is made in full. Interest will accrue on a daily basis from the due date             until the actual date of payment, whether before or after judgment; and
3e2. Send you reminder letters charged at £12 per letter until the debt is paid off.
3e3. If you have promptly contacted me to dispute an invoice in good faith, we will not charge                   interest while such a dispute is ongoing.
3e4. You will be responsible for paying the costs we incur in recovering, or attempting to recover,           any unpaid fees or supplemental charges from you (including reasonable legal costs being               costs that would be allowable by the courts if judgment was made in Mobile Pet Care                         Services).
 
4. Our Services
 
4a. I will provide the Service in accordance with the details set out in the ‘Form’.
 
4b. I will begin to provide the Service on the agreed start date and will continue to provide the               Services until the Contract is terminated by you or me in accordance with these Terms of                 Business.
 
5. Problems with the Service
If there is a problem with the Service, I request that you inform me as soon as is reasonably possible. I will use reasonable efforts to remedy problems with the Service as quickly as is reasonably possible and practical.
 
6. Complaints and Feedback
I always welcome feedback from customers and, while I always use all reasonable endeavours to ensure that your experience as a customer of mine is a positive one, I would like to hear from you if you have any cause for complaint.

7. Cancellations
7a.      In the event of the Client canceling the Services, the Client agrees to pay Mobile Pet Care                  Services a fee equal to:
7a1.    100% of the Fees if cancellation occurs less than 48 hours of the scheduled service;
7a2.    50% of the Fees if cancellation occurs between 48 hours and 14 days of the scheduled                      service;
7a3.    the non-refundable deposit, as set out in the Booking Form, if cancellation occurs not less                than 14 days of the scheduled services.

7b.      In the event of Mobile Pet Care Services cancelling or otherwise not being able to provide                the Services I shall either:
7b1.    arrange alternative services or providers to a value and quality that would have been                        provided; or
7b2.    refund any monies paid under this Agreement for the Services; and
7b3.    in either case, provide 24 hours’ notice, or if 24 hours is not practical, for example in a                      sudden event or emergency, notice as soon as it is reasonably possible.
 
8. Events Outside of Our Control (Force Majeure)
I will not be liable for any failure or delay in performing my obligations under the Contract where the failure or delay results from any cause that is beyond my reasonable control. Such causes include, but are not limited to: power failure, internet service provider failure, strikes, lock-outs or other industrial action by third parties, riots and other civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism (threatened or actual), acts of war (declared, undeclared, threatened, actual or preparations for war), epidemic or other natural disaster, or any other event that is beyond my reasonable control.
 
9. Other Important Terms
9a. We may from time to time change these Terms of Business without giving you notice.
 
9b. If any provision of the Service Agreement or these Terms of Business is held by any Court to           be invalid or unenforceable in whole or in part the validity of the other provisions of the                     Contract and the remainder of the provision in question will not be affected.
 
9c. All intellectual property belonging to Mobile Pet Care Services (including, without limitation,             any information, documentation and/or materials produced in connection with the Services) are       and shall remain fully vested in me. Nothing in these Terms shall grant to you any rights to, or         in, patents, copyrights, database rights, images, trade names, trademarks (whether registered         or unregistered), or any other rights or licences in respect of the Services. 
 
9d. We shall hold and process your data in accordance with The General Data Protection                         Regulation 2016/679. See our Privacy Policy.
 
10. Law and Jurisdiction
These Terms of Business, the Agreement, and the relationship between you and me (whether contractual or otherwise) shall be governed by and construed in accordance with the law of England & Wales.
 
Service Agreement
This Service Agreement contains the terms which are applicable to Mobile Pet Care Services. Please read them carefully and ensure that you understand and agree to them. If you have any questions, please contact me.
 
The Agreement
Any reference to ‘I’ or ‘me’ means Mobile Pet Care Services.
Any reference to ‘you’ is you the customer.
Any reference to ‘Service’ means a pet service detailed at https://www.mobilepetcareservices.com/services-1
which you have booked.
(1) We provide pet care services to customers pets and I have the reasonable skill, knowledge and experience in this field.

(2) You wish to engage my services as set out in this Agreement, the Terms of Business and the ‘Form’, subject to the terms.

(3) I agree to provide the Service to you on the following terms. This Agreement, the Terms of Business and the ’Form’ constitute a Contract between me and you.
